Services are delivered remotely unless otherwise agreed.


3. Client Responsibilities

Clients agree to:

  • Maintain account security

  • Pay invoices on time

  • Use services lawfully

Clients are responsible for all activity under their account.


4. Payments

We accept payments via:

  • Stripe

  • PayPal

  • Bank transfer

All payments must be made in full before service activation unless otherwise agreed.


4.1 Deposits

Development projects require a non-refundable deposit (typically 50%).


4.2 Late Payments

Late payments may result in:

  • Service suspension

  • Additional fees

  • Legal recovery action


5. Subscriptions

Some services are recurring (monthly/annual).

Subscriptions:

  • Renew automatically

  • Must be canceled before renewal

  • Are non-refundable mid-cycle


6. Refunds

Refunds are governed by our separate Refund Policy.


7. Hosting Acceptable Use

Prohibited activities include:

  • Illegal content

  • Copyright infringement

  • Spam

  • Malware distribution

  • Phishing

  • Crypto-mining abuse

  • High-risk industries without approval

Violations may result in immediate suspension without refund.


8. Intellectual Property

Upon full payment:

  • Client owns final deliverables

  • Servgator retains rights to frameworks, internal systems, and reusable components

Servgator may display work in portfolio unless agreed otherwise.


9. Limitation of Liability

Servgator’s total liability shall not exceed the amount paid for the service in question.

We are not liable for:

  • Indirect damages

  • Loss of revenue

  • Data loss beyond backup policies

  • Third-party service failures


10. Indemnification

Clients agree to indemnify Servgator against claims arising from:

  • Client content

  • Copyright violations

  • Misuse of services

  • Illegal activities


11. Service Suspension & Termination

We may suspend or terminate services if:

  • Payment is overdue

  • Terms are violated

  • Fraud is suspected

  • Abuse is detected

No refund will be issued for violations.


12. Force Majeure

We are not liable for delays or failures due to:

  • Natural disasters

  • Infrastructure outages

  • Government restrictions

  • Cyber attacks beyond reasonable control


13. Chargebacks & Disputes

Clients agree to contact Servgator before filing disputes via:

  • Stripe

  • PayPal

  • Bank

Fraudulent chargebacks may result in:

  • Immediate suspension

  • Administrative fees

  • Legal action


14. Governing Law

These Terms are governed by the laws of England and Wales.

Disputes shall be subject to UK jurisdiction.


15. Modifications

We reserve the right to update these Terms at any time.
Continued use of services constitutes acceptance.
